Notice of REEF Special General Meeting

Notice is hereby given to financial members of the Real Estate Employers' Federation that a Special General Meeting will be held on Thursday, 4 April 2019.

Details of the meeting are as follows:

Agenda

To vote on the following motions:

Motion 1

The Real Estate Employers' Federation will make application to the Supreme Court of NSW to seek cancellation of its registration under the Industrial Relations Act 1996 as an industrial organisation.

MOTION 2

Provided the Supreme Court of NSW approves the application for cancellation, the State Organisation will be dissolved as soon as practicable in accordance with Rules 43(1) and 43(2) of the rules of the State Organisation.

MOTION 3

In the event that the State Organisation is dissolved, any surplus income, and real and personal property of the State Organisation shall be given or transferred to the federally registered body known by the same name and being an Organisation having similar objects of the registered State Organisation.

 

Background information

The Real Estate Employers’ Federation is currently registered under two separate Acts of Parliament.

The first of these is our state registration under the provisions of the Industrial Relations Act 1996 (NSW).

When Australia’s national workplace relations system started on 2009, REEF applied for and was granted federal registration under the Fair Work (Registered Organisations) Act 2009 (Cth).

Since then REEF has maintained these dual registrations despite the state registration now being entirely redundant.

Why de-register?

The Real Estate Industry Award is an award made under the Fair Work Act 2009 (Cth) and it's therefore under the national workplace relations system that REEF operates.

In consultation with REEF’s lawyers, the Committee of Management has determined that there's no ongoing need to maintain the state registration and that the process of de-registration should commence. This will relieve REEF from the extensive administrative burden and substantial compliance costs of maintaining dual registrations.

What does this mean for you?

Nothing.

The cancelling of the state registration will have no impact on your membership and the service offering by REEF.
